Terms and Conditions
1. Organiser
1.1. The Northern Territory Department of Industry, Tourism and Trade, Department of Agriculture Fisheries and Forestry and MusicNT Incorporated are the Organisers of the Music Competition.
1.2. The Organisers invite Entrants to submit recordings of original musical compositions linked to the topic of biosecurity.
2. Acceptance
2.1. By entering this music competition, the entrant implies complete acceptance of these terms and conditions.
3. Eligibility
3.1. Entry is open to residents of the Northern Territory only (living in the NT from 16 July 2022).
3.2. Employees of the Organiser (and their immediate family) are ineligible to enter.
3.3. Song entries must be the original musical work of the entrant.
3.4. Songs must include both lyrics and music. Purely instrumental works are ineligible.
3.5. Songs that have been commercially released and/or are available for sale or monetisation through streaming channels are not eligible for entry.
3.6. Songs co-written by multiple writers are eligible for entry. However, an individual song may be entered only once, under the name of a single Entrant.
3.7. Entrants who are under the age of 18 years old on entry must have a parent/guardian’s approval to enter the competition. The parent/guardian must read and consent to these terms and conditions. Minor Entrants may be disqualified in the event that their parent or guardian refuses a reasonable request by the Organiser to enter into a further agreement as evidence of consent to the minor entering the competition or sign further documentation in the event that the minor entrant is a winner of the competition.
4. Entry Requirements
4.1. The Entrant must enter by following the directions on the competition website https://envirosongcomp.musicnt.com.au/ and completing all required fields on the forms.
4.2. Each song must be submitted with its lyrics.
4.3. Entrants must submit 1 song per entry.
4.4. For songs sung in languages other than English, the Entrant must provide an English translation.
4.5. All songwriters must be clearly listed on the entry form.
4.6. An individual song may only be entered once into either the Schools, Group or Solo Category. Each song entered will automatically be eligible for the additional prize categories (Most Innovative and Creative and People’s choice).
4.7. Songs must be in MP3 format and less than 6MB.
5. Competition Period
5.1. The competition commences on Tuesday 17 July 2024 and closes 12 noon on Friday 20 September 2024. The Organiser will not be liable for any changes to the competition period.
5.2. All entries must be received by the Organiser prior to the end of the competition period. Entries are taken to be received at the time of receipt by the Organiser not time of submission by the Entrant.
6. Warranties and Indemnities
6.1. By entering the competition, the Entrant warrants to the Organiser in respect to each song entered:
6.1.1.The Entrant is the author or co-author of the song.
6.1.2.The entrant has obtained written permission from any co-writer holding any rights in the song.
6.1.3.The entrant has provided a copy of these terms and conditions to co-authors.
6.1.4.The entrant owns the copyright in the song and is entitled to enter the song as part of the competition.
6.1.5.The song does not infringe the rights of any third party, including copyright, and all efforts have been taken to avoid such infringement.
6.1.6.The song is not offensive, inappropriate, or defamatory.
6.2. By entering the competition, the entrant agrees they shall indemnify the Organiser from and against any legal claims which may arise as a result of breach of the above warranties.
7. Judging
7.1. The Organiser will appoint a judging panel made up of music and biosecurity industry professionals from across Australia.
7.2. Entries will anonymous, given a unique identification number and personal identifiers removed before judging.
7.3. Entries will be judged equally on creativity, originality, lyrics, melody, and lyrical alignment to biosecurity. Production value and the quality of the performance and sound recording will not be considered.
7.4. Each entry will be reviewed by the judging panel and judged on its merits and qualities set out in 5.3 to determine the winners.
7.5. Judgement of entries is at the absolute discretion of the Organiser and Judging panel. The decisions with respect to the competition are final, no feedback or critique will be provided.
8. Winners
8.1. The Organisers will use their best efforts to announce winners by Friday 6 December 2024 but will not be held liable for any unforeseen delays in the judging process.
8.2. The winners will be notified by email or telephone. The winners will also be posted on the website.
8.3. By entering, Entrants may be offered to publicly perform their winning song at the request of the Organiser for a 12 month period from the close of the Competition at the cost of the Organiser. Entrants may also be offered to conduct various media interviews as requested by the Organiser.
9. Prize
9.1. The prize awarded to the winners includes the following:
9.1.1.The entrant determined the Schools Winner will receive AUD $2,500 cash.
9.1.2.The entrant determined the Groups Winner will receive AUD $2,500 cash.
9.1.3.The entrant determined the Solo Winner will receive AUD $1,500 cash.
9.1.4.The entrant determined the Innovative and Creative Winner will receive AUD $2,500 cash.
9.1.5.The entrant determined the Peoples Choice Winner will receive AUD $2,500 cash.
9.2. The total prize is estimated to be valued up to AUD $11,500. The Prize values are correct as at time of publishing, with no responsibility accepted by the Organiser for any variation in the value of the prize or part of the prize. Other prizes may be added during the competition at the discretion of the Organiser.
9.3. The relevant prize will be awarded in full to the individual entrant who submitted the song.
9.4. The division of Prize money among co-writers (if any) is the responsibility of the Entrant.
9.5. If a winning Entrant is a minor, the Prize, or part of that Prize will be awarded to the minor Entrants parent/guardian on the entry forms on the minors behalf, at the discretion of the Organiser.
9.6. The prize is not transferable or exchangeable.
9.7. The Organiser reserves the right, in its absolute discretion, at any time during the Competition period, to vary, withdraw, postpone, or cancel the Competition or prize including but without limitation, in circumstance where it cannot conduct the Competition or grant any part of the prize for any reason beyond its control. In the event the competition is withdrawn or cancelled in its entirety, Entrants will be notified.
10.Copyright
10.1. The copyright in songs entered will remain the property of the entrant.
10.2. By entering the competition, all Entrants grant to the Organiser a non-exclusive, royalty free licence in perpetuity to use, reproduce, broadcast, edit or adapt and distribute their song, including to third parties, for the promotion of the Music competition and future associated events including but not limited to: on the Organisers website and through its social media channels, public radio stations, YouTube, and other media platforms.
10.3. The Entrants also grants the Organiser the right to grant sub-licences to a third party on the same terms and conditions as the above licence.
11. Privacy
11.1. All personal details of the Entrants will be held in accordance with the Information Act 2002 (NT). Any personal information will only be used for the purpose of administering the competition. The Organiser will not, without the Entrants consent, disclose or permit access to the entrant’s personal information other than for the purpose of the competition.
11.2. The entrant consents to the Organiser using and sharing the Entrants and or groups name on online and media platforms, and to third parties, to attribute authorship.
